El terrorismo al amparo de la reforma efectuada por la Ley Orgánica 5/2010: concepto y elementos

Abstract

La reforma del Código penal realizada por la LO 5/2010, de 22 de junio ha afectado de manera sustancial y directa a la regulación del terrorismo y de los delitos terroristas. Una de las principales y más importantes novedades radica en la incorporación de un concepto de organizaciones y grupos terroristas que contiene los elementos que tradicionalmente se habían identificado por la doctrina y la jurisprudencia Por otro lado, el cambio radical que supone pasar de un terrorismo nacional o sectorial a un terrorismo religioso, fundamentalista y global, nos obliga a efectuar una análisis de las notas esenciales del mismo a fin de determinar su adecuación o no al concepto y elementos incluidos en el Código penal. ---------------------------------------------------------------------------------------------------------

One of the main and most important innovations takes root in the incorporation of a concept of organizations and terrorist groups that it contains the elements that traditionally had been identified by the doctrine and the jurisprudence On the other hand, the radical change that supposes going on from a national or sectorial terrorism to a religious, fundamentalist and global terrorism, it forces us to carry out an analysis of the essential notes of the same one in order to determine its adequacy or not to the concept and elements included in the Criminal code.
