Abstract
En este artículo se pretende arrojar algo de luz sobre la cuestión de los “delitos culturales”
(conductas aceptadas por culturas subalternas que constituyen delito de acuerdo con la ley penal). Para
ello, considerando las constituciones estatales y los tratados internacionales como fuente de Derecho
penal, intentamos reconstruir un marco constitucional del que deducir el legítimo ámbito de decisión del
legislador en esta materia.
This article aims at sheding light on the issue of cultural offence/offense (a behaviour that is accepted by a minority culture and that falls under a criminal law provision). For this purpose, taking into consideration both state constitutions and international treaties as sources of criminal law, a constitutional framework is to be designed, from which it is posible to draw limitations for the law-making process on the subject matter.
