Abstract

El artículo debate, a partir de las bases de la filosofía del lenguaje aplicada al sistema de imputación penal, la culpabilidad de personas jurídicas. Para tanto, presenta antes los fundamentos necesarios para la superación de las exigencias del principio de culpabilidad para, seguidamente, tratar de ofrecer un análisis de la culpabilidad como categoría de la teoría del delito. ---------------------------------------------------------------------------------------------------------

The article discusses, based on the philosophy of language applied to the criminal law attribution system, the subjective dimension of the legal persons criminal liability. To seek this goal, it first presents the foundations necessary for overcoming the requirements of the principle of subjective liability and then attempts to offer an analysis of “culpability” as an element of the criminal liability attribution system.
