El valor fundamental del derecho de acceso del artículo 105 b de la Constitución española y su relación con la transparencia algorítmica

Abstract

No se le oculta a nadie que el uso normalizado de la inteligencia artificial y de los algoritmos han impactado, por lo general, positivamente en la vida del ser humano. Suponen un plus de eficacia y de eficiencia en las labores desarrolladas tanto por los entes públicos como privados. Su capacidad in crescendo en materia de predicción, análisis y evaluación, en diferentes sectores de la vida, son innegables en cuanto suponen una mejora del bienestar individual y colectivo apuntado por la Constitución. En este contexto se insiste en la falaz auto-referencialidad de los procesos tecnológicos evitando de este modo cualquier tipo de control valorativo sobre los mismos, y por ende la posibilidad de someterlos al escrutinio público. Argumento funcional o útil en términos pragmáticos ya que puede surtir efectos ante los interlocutores reales o potenciales, pero en absoluto puede considerarse como racional ya que anula cualquier condición de la comunicación misma y en consecuencia de la argumentación. El derecho de acceso al algoritmo y a su código fuente tiene sobrada apoyatura en la norma fundamental. Ante el retraso del legislador en regular de modo cabal el uso de esta tecnología reconociendo nuevos derechos, la labor interpretativa que pueda realizarse en sede judicial y/o doctrinal no resultaría a nuestro juicio ayuna de razón ni huérfana de antecedentes que la sustenten. Una interpretación finalista del derecho de acceso permite sostener la conexión dable entre el derecho de acceso a los algoritmos y el derecho a libertad de información en cuanto su ejercicio haría más transparente el Estado

It is not hidden from anyone that the standardized use of artificial intelligence and algorithms have generally had a positive impact on the lives of human beings. They represent a plus of effectiveness and efficiency in the work carried out by both public and private entities. Its growing capacity in terms of prediction, analysis and evaluation in different sectors of life are undeniable insofar as they imply an improvement in individual and collective well-being as indicated by the Constitution. In this context, the fallacious selfreferentiality of technological processes is insisted on, thus avoiding any type of value control over them, and therefore the possibility of subjecting them to public scrutiny. Functional or useful argument in pragmatic terms since it can have effects before the actual or potential interlocutors, but it cannot be considered as rational at all since it annuls any condition of the communication itself and consequently of the argument. The right of access to the algorithm and its source code has ample support in the fundamental norm. Given the legislator’s delay in fully regulating the use of this technology, recognizing new rights, the interpretative work that can be carried out in judicial and/or doctrinal venues would not, in our opinion, be lacking in reason or devoid of antecedents that support it. A finalist interpretation of the right of access makes it possible to sustain the possible connection between the right of access to algorithms and the right to freedom of information insofar as its exercise would make the State more transparent
