Abstract
En la sociedad de la información la desinformación es un riesgo real que tiene consecuencias graves en la vida y en la sociedad casi en cualquier ámbito, como puede ser el turismo, la economía o la política entre otros. Los sistemas de inteligencia artificial que se presentan como grandes herramientas capaces de generar información a través del análisis de millones de datos pueden jugar a la contra ante la posibilidad de generar fake news que las personas que las reciben tomen como verdad; y ello es peligroso, porque condiciona el pensamiento y la forma de actuar de esa sociedad que las recibe. Plantear respuestas, al menos desde el prisma jurídico-penal, no es tarea fácil sin caer en posibles planteamientos autoritarios contrarios a las libertades propias de una democracia en la que rijan los valores y principios de un Derecho penal garantista.

In the information society, misinformation is a real risk that has serious consequences in life and society in almost any field, such as tourism, the economy, or politics, among others. Artificial intelligence systems that are presented as great tools capable of generating information through the analysis of millions of data points can backfire by creating fakes news that people may take as truth, which is dangerous because it influences the thinking and behavior of the society that receives it. Proposing responses, at least from a legal-criminal perspective, is not an easy task without falling into possible authoritarian approaches that contradict the freedoms inherent in a democracy governed by the values and principles of a protective criminal law.
