Teoría política libertaria y política criminal

Abstract

¿En qué casos podría llegar a considerarse justificada desde la perspectiva de una teoría política libertaria la práctica estatal de prohibir acciones y sancionar a sus autores (por infractores)? Esta es la pregunta con la que se inicia el presente trabajo y también la cuestión que guía el contenido del mismo. La teoría política libertaria no sostiene un modelo de sociedad justa sino únicamente una teoría normativa acerca de las condiciones en las que surge, de forma moralmente justificada, la autoridad política, por lo que en este trabajo se pretende poner de manifiesto su trascendencia como teoría política en sede criminal.

In what cases could the state practice of prohibiting actions and punishing the perpetrators (as offenders) be considered justified from the perspective of a libertarian political theory? This is the question with which the present work begins and also the question that guides the content of it. The libertarian political theory does not support a fair society model but only a normative theory about the conditions in which political authority arises, in a morally justified way, so that in this work, it is intended to show its transcendence as political theory in a criminal subject.
