La sucesión de las leyes penales en el tiempo

Abstract

El tema de la sucesión de leyes penales en el tiempo constituye uno de los capítulos más importantes de la teoría general del delito. Se relaciona directamente con la problemática de la irretroactividad de la norma penal que, como se sabe, se refleja hasta la exigencia primaria conectada con la originaria afirmación del principio de legalidad. Se analiza la disciplina del vigente Códice Penale de 1930, partiendo de la reglamentación del Código liberal Zanardelli de 1889, teniendo en cuenta los criterios elaborados sobre la doctrina y la jurisprudencia. El artículo examina también la función políticocriminal que puede, de hecho, ser punto de inflexión del fenómeno de la sucesión de normas penales, adelantando la posibilidad de un cortocircuito peligroso en las relaciones entre el poder legislativo y el poder judicial y subrayando la voluntad jurisprudencial en la materia.

The issue of criminal codes succession in time is one of the most important topics in general crime theory. It is directly linked to the non-retroactivity of crime regulation which is knowingly reflected in the primary demand related to the original affirmation of the legality principle. Discipline in the prevailing 1930 Códice Penale is assessed beginning with the regulation of liberal 1889 Zanardelli Code, considering the criteria developed on the doctrine and jurisprudence. This paper also examines the political-criminal function, which can be in fact a turning point in the matter of he succession of penal rule, and foresees the possibility of a dangerous short circuit in the relations between legislative power and judicial power stressing the jurisprudential interest in the matter.
