Aproximación al concepto de pena en el ordenamiento Jurídico-penal Español

Abstract

En el presente artículo se aborda el concepto de pena desde la óptica del Ordenamiento jurídico-penal español y, a propósito del mismo, se reflexiona acerca de la exclusión de la pena netamente retributiva en la legislación española, a favor de las finalidades preventivas. Finalmente, se hace referencia a los principios informadores del sistema de penas en el Ordenamiento jurídico-penal español.

This article deals with the concept of grief from the viewpoint of the Spanish juridical and penal system, and, on the other, it reflects on the exclusion of the penalty purely retribution in Spanish legislation, in favour of the preventive purposes. Finally, it refers to the informing principles of the system of penalties in the Spanish juridical-penal order.
