Abstract
En los últimos tiempos se ha producido un notable incremento en la introducción de tipos penales que afectan directamente el ejercicio de los derechos fundamentales, porque los limitan o incluso, eliminan. Se sancionan delitos de expresión, de opinión, se criminaliza el silencio y se atenta contra la presunción de inocencia. Con ello se están poniendo en peligro las bases y fundamentos de un sistema democrático y de un Estado de derecho. El objeto de este trabajo se centra en la delimitación de la situación actual y el análisis de algunos de los tipos penales concretos que atentarían directamente contra los derechos mencionados.

Crimes related to expression, opinion, the criminalization of silence, and violations of the presumption of innocence are being sanctioned. This poses a threat to the foundations of a democratic system and the rule of law. The aim of this paper is to focus on the current situation and analyze some specific criminal offenses that would directly infringe upon the aforementioned rights.
