La educación totalitaria o criminal: ¿una causa de exculpación?

Abstract

En este trabajo abordamos una problemática penal escasamente abordada, el efecto jurídico-penal del déficit de socialización por educación totalitaria y/ criminal. En los procesos de socialización pueden existir situaciones intensas del entorno social y educativo que generen fuentes de riesgo en la orientación del sujeto conforme a la norma, especialmente en contexto por educación totalitaria y/o crimi-nal imputable a terceros. La intensidad de estos déficits puede llevar al sujeto a cometer delitos durante la minoría de edad y, en ocasiones, prolongarse en la mayoría edad. Hemos razonado que la intensidad de los defectos educativos atribuible a tercero puede anular o rebajar la exigibilidad de una conducta conforme a derecho, hallando amparo legal en casos especiales en el estado de necesidad exculpante

In this work we address a criminal problem that has been barely addressed, the legal-criminal effect of the deficit of socialization due to totalitarian and/or criminal education. In the socialization pro-cesses there may be intense situations in the social and educational environment that generate sources of risk in the orientation of the subject according to the norm, especially in the context of totalitarian and/or criminal education attributable to third parties. The intensity of these deficits can lead the subject to commit crimes when they are minors and, on occasions, continue into adulthood. We have reasoned that the intensity of the educational defects attributable to a third party can nullify or reduce the enforceability of a conduct in accordance with Law, finding legal protection in special cases in the state of exculpatory necessity
