aún presentes en el Código penal, pese a que éstas resultan incompatibles con algunos principios
del Derecho penal sustantivo y procesal
This paper traces a short overview on several assumptions used by the Spanish legislator to define typical behaviors or one of their elements, based on some suppositions still present in the criminal code even though they are incompatible with some of the principles in substantial and procedural criminal law.
