Moderna revisión del delito de tráfico de drogas: estudio actual del art. 368 del Código Penal

Abstract

Se trata de abordar una moderna interpretación del bien jurídico «salud pública», y un análisis detallado de los elementos de delito de «tráfico de drogas» como referente de los delitos de peligro. A su vez se realiza un estudio sobre la forma tan abierta de concebir la multiplicidad de conductas típicas de tráfico de drogas. Por último examinamos la configuración del tráfico de drogas como delito de mera actividad que no necesita para su consumación la consecución material de un resultado que rebase el simple comportamient, y la dificultad de apreciar en él formas imperfectas de ejecución

We are trying to approach a modern interpretation of «public health», and a detailed analysis of the elements of crime called «traffic of drugs» as paradigm of the crimes of danger in Penal Law. The study is realized on an opened way of conceiving the multiplicity of typical conducts of traffic of drugs. Finally we examine the configuration as crime of activity that does not need for its consummation the material attainment of a result that exceeds the simple behavior, and the difficulty of estimating in its imperfect ways of execution
