Abstract
Junto a la laboral, una de las discriminaciones tan frecuentes como carentes de respuesta en la práctica
por el Ordenamiento es la consistente en la denegación de acceso a lugares abiertos al público. En este trabajo se
aborda el análisis del artículo 512 del Código penal, introducido por el legislador en 1995 para luchar contra las
discriminaciones en la realización de actividades profesionales y empresariales, ofreciendo una interpretación del
mismo que compatibilice la defensa del derecho a no ser discriminado con la garantía del núcleo fundamental de la
autonomía privada.
Together with employment discrimination, one of the most predominant discriminatory practices still lacking a practical response from our legal system is the denial of equal access to public accommodations. This paper addresses an analysis of article 512 of the Criminal Code, introduced by the legislature in 1995 in an effort to combat discrimination in professional and business practices, and offers an interpretation that attempts to reconcile the protection of the right to non discrimination with the fundamental core of the principle of private autonomy.
