La protección penal de la Seguridad Social en España: el bien jurídico protegido.

Abstract

El presente trabajo aborda una parte de aquello que se ha venido a denominar “Derecho penal de la Seguridad Social”, el cual es el estudio del interés jurídico protegido por estos delitos. En España, la institución de la Seguridad Social ha ido cobrando, con el tiempo, destacada importancia, por lo que también la respuesta penal debe ser objeto de examen crítico. Como parte de un estudio más completo, en estas páginas se ofrece una concepción propia sobre el objeto de protección en estos delitos, actualizada a la luz de la reforma operada por la LO 7/2012 en el Código Penal español, y a la luz del texto constitucional.

This paper deals with a part of what has been denominated as "Criminal Law of Social Security", which is the study of the legal interest protected by these crimes. In Spain, the Social Security Institution has been gaining, with time, outstanding relevance, so the penal response must be object of critical examination as well. As part of a more complete study, in this pages it is offered an own conception of the object of protection in these crimes, updated in the light of the reform operated by the LO 7/2012 in the Spanish Penal Code and the constitutional text.
