Algunos límites de la tentativa con arreglo al Código Penal

Abstract

El CP/1995, art.16.1, estableció que los actos que debieran producir el resultado no originado, habían de ser los que «objetivamente» lo ocasionarían. De la incorporación de este término a la definición legal de tentativa, se han derivado distintas interpretaciones sobre su alcance en relación con las exigencias o no de peligrosidad ex ante y peligro ex post (potencial o real) para la apreciación de la tipicidad y, como consecuencia, de la que pueda predicarse de las tentativas inidóneas, irreales y supersticiosas. Lo que de ordinario se ha efectuado sin tomar en consideración lo dispuesto por el art. 62 CP. Con unos u otros planteamientos se ha pretendido solventar o denunciar la falta de respuesta incriminadora de diversas hipótesis. El presente trabajo toma posición sobre todos los asuntos y supuestos anteriormente indicados o aludidos

The current Spanish Penal Code (CP/1995) establishes that acts leading to an unrealized result ought to be those that would «objectively» cause it. The incorporation of this term to the legal definition of attempt has led to different interpretations concerning the role of requisites such as ex ante peligrosity and ex post —potential or actual— danger in the consideration of typicity, including that derived from non-idoneous, imaginary or superstitious attempts. Such interpretations have normally left unconsidered the norm contained in art. 62 CP. From different standpoints, they aim at either positing a solution or revealing a lack of legal scope by the Code. This work takes on its own point of view by considering all the abovementioned matters and hypotheses
