Abstract
En el presente artículo se describen los grandes rasgos de dos concepciones del debido proceso legal en materia penal: la formal o procedimental, por un lado, y la sustantiva, por el otro. La primera lo reduce al cumplimiento de las formalidades esenciales del procedimiento como parte fundamental de la llamada garantía de audiencia prevista en el artículo 14 de la Constitución mexicana; la segunda, en cambio, lo eleva a la categoría de los derechos fundamentales a partir de su conexión con los valores y principios que rigen actualmente al derecho penal mexicano
In this article the most important features of two different conceptions on due process of law are described. On the one hand, the formal o procedural conception; on the other, the substantive view. While the former consists in the so called “legal formalities” within the criminal process, the last one recognizes it as a true fundamental right in deep connection with the whole range of principles and values that actu-ally rules the Mexican criminal law
