Sobre el futuro de la ciencia jurídico penal alemana: apertura y método discursivo en lugar de provincianismo presuntuoso

Abstract

La ciencia jurídico penal alemana se encuentra ante una encrucijada: o se abre a la internacio - nalización y europeización o se mantiene anclada en un “provincianismo presuntuoso” [“selbstbewusster Provinzialität”]. 2 Con Joachim Vogel falleció prematuramente uno de los representantes más influyentes de una nueva generación de profesores alemanes de Derecho penal, la cual abogó desde muy temprano por dicha apertura, precisamente con miras hacia una verdadera ciencia jurídico penal internacionali - zada y europeizada. Vogel cuestionó 3 con razón las tendencias dominantes en Alemania, “caracterizadas por la sobre-estimación, obstinación y negación en contra de las corrientes internacionales y europeas”. 4 Asimismo, reclamó la apertura metodológica y sustancial de esta disciplina, al igual que la democrati- zación del discurso jurídico penal. En esta corta contribución en su memoria serán recordadas las ideas más importantes de Joachim en relación con este debate; también se intentará fortalecerlas y ampliarlas parcialmente. Para esto procederé en tres pasos: en primer lugar serán presentados algunos hallazgos, posteriormente se señalarán sus razones y finalmente se propondrán algunos cambios que se consideran necesarios.

German criminal law theory stands at a crossroads: either the field opens itself up to inter - nationalisation and Europeanisation, or it continues to persist in its “confident provincialism”. 1 Joachim Vogel’s untimely death has deprived us of probably the most influential representative of a new generation of German criminal law theorists, who was one of the first to argue in favour of this move towards greater openness – towards a truly internationalised and Europeanised criminal law theory. Vogel rightly lamented the “tendencies of overestimation, resistance to change, and denial towards international and European ideas” 2 prevalent in Germany and demanded that our field open itself up both in terms of its methodology and content, further calling for greater democracy in criminal law discourse. In this small contribution dedicated to his memory, Joachim’s key thoughts on this debate will be recalled, essentially confirmed and then (in part) developed further. In doing so, I will proceed in three stages: first, several findings will be presented. Then the reasons underlying these findings will be explained, and finally the article will conclu - de with a call for the necessary changes.
