Abstract
Este trabajo analiza las distintas perspectivas sobre el papel del resarcimiento del daño en la vía penal, explorando modelos que lo consideran como una función reparadora, punitiva o preventivo-punitiva. Se discuten las ventajas y críticas asociadas a cada enfoque, con énfasis en el debate acerca de si el resarcimiento debe limitarse a reparar el daño o incorporar elementos sancionadores que puedan contradecir los principios del derecho penal y civil. Además, se reflexiona sobre las implicaciones jurídicas, doctrinales y constitucionales de adoptar diferentes modelos en el contexto del derecho español y comparado.
