Abstract
Este artículo presenta una actualización de la conceptualización del crimen organizado
con la intención de impulsar así una reforma en la política criminal y el derecho penal aplicados en
la lucha contra este tipo de delincuencia. existe cierta incongruencia respecto a su definición actual
y los instrumentos principales de la lucha contra el crimen organizado al no tomar suficientemente
en cuenta su componente motivacional, lo que dificulta su control y posible erradicación, siendo así
necesarios diversos cambios que adapten la lucha contra el crimen organizado a su nueva realidad
This article presents an update on the conceptualization of organized crime with the aim of promoting a reform in criminal policy and penal law applied in the fight against this type of criminal activity. there is a certain inconsistency regarding its current definition and the main instruments in the fight against organized crime, as it does not sufficiently take into account its motivational component. this lack of consideration hinders its control and potential eradication, making various changes necessary to adapt the fight against organized crime to its new reality
