Abstract
En muchas ocasiones se ha acusado a Beccaria de plagiar las ideas que exponían otros. Pese a ser esto parcialmente cierto, no cabe duda de su mérito por haber sintetizado muchas de estas ideas en un breve opúsculo, redactado de forma sencilla y brillante, que ha conseguido mantener su vigencia du-rante dos siglos y medio. En todo caso, por lo que se refiere al razonamiento en relación con la tortura, el rechazo que Beccaria hace de la misma es total, sin ningún tipo de reservas o excepciones, y no solo por razones puramente utilitaristas, sino también por razones humanistas y de justicia

Although this is partially true, there is no doubt that his merit for having synthesized a lot of these ideas in a short booklet, written in a simple and brilliant way, has manage to maintain its validity during two and a half centuries. Nonetheless, as far as the reasoning related to torture is concerned, the rejection that Bec-caria had to it is whole, without any reservation nor exception, and not only because of purely utilitarian reasons, but also because of justice and humanist motives
