La etapa de investigación en el nuevo sistema de justicia acusatorio

Abstract

El documento se refiere a la reforma constitucional mexicana que adopta un sistema de justicia oral-acusatorio tanto federal como local. Los autores examinan la etapa de investigación. Ponen especial énfasis en el riesgo implícito en fi jar un alto estándar probatorio para iniciar la investigación formalizada, pues ello puede marcar el regreso del sistema inquisitorial donde el verdadero juicio tiene lugar en la averiguación previa, y el juicio ordinario se convierte en una mera formalidad.

The paper is related to the Mexican constitutional reform by which an oral-adversarial justice system must be implemented both at the federal and state level. The authors review the “closed” and “opened” stages of the preliminary investigation. They emphasize a high standard of proof requested for an under judicial control investigation would lead to the reinstatement of the inquisitorial system where the real trial takes place at a pretrial stage and the trial becomes a formality.
