Abstract

Este trabajo aborda la reciente modificación del CP italiano en materia de legítima defensa, la Ley n. 59/2006 titulada «modificación del art. 52 del Código penal en materia de derecho a la autotutela en un domicilio particular». A partir de la diferenciación entre reglas de comportamiento y reglas de juicio, el autor analiza la función del nuevo texto legal, y propone una interpretación del mismo que no altera el balance entre los intereses del agresor y agredido en que se basa la legítima defensa conforme a los valores constitucionales. ---------------------------------------------------------------------------------------------------------
This paper deals with the the recent amendment of the regulation of the self defense in the Italian Penal Code. The Law. 59/2006 has introduced a new rule concerning the right to use the self defense in a private home o commercial premises. Utilizing the distinction between rules of behavior and rules of judgment, the auto analyzes the role of the new text, and proposes an interpretation consistent with the balancing between the interest of the aggressor and aggressed that sharp the institution of the self defense under constitutional values.
