Abstract
Este trabajo muestra dos de las principales formas de pensar acerca de los fenómenos del delito y de la pena. Una, como historia de las ideas de la pena, y otra, como una economía política de la pena. Optando por la segunda forma como método de reflexión, junto con elementos propios del psicoanálisis, se llega a la conclusión de que el Derecho penal es incapaz para funcionar como instrumento de control de la criminalidad en las sociedades neoliberales contemporáneas.

This paper manifests the two main ways of thinking the phenomenons of crime and punishment. One as a history of ideas about punishment, and the other as a political economy of punishment. By opting for the second way as a method of reflection, in addition to elements brought from psychoanalysis, it follows that criminal law is unable to function as an instrument of crime control in contemporary neoliberal societies.
