Principios, antinomias, derrotabilidad… misterios y aporías del neoconstitucionalismo y sus parientes cercanos

Abstract

Las teorías del Derecho actuales que son contrarias al positivismo jurídico están necesariamente asociadas al objetivismo moral. Ponen la moral verdadera por encima de las normas jurídicas positivas y por encima también de la Constitución, y convierten la moral verdadera en la auténtica Constitución. Como la moral es lo más importante del Derecho y la moral se presenta en el Derecho bajo la forma de principios, no hay antinomias entre los principios ni hay principios jurídicos injustos.

Current legal theories that are contrary to legal positivism are necessarily associated with moral objectivism. They put true morality above positive legal norms and also above the constitution, and make true morality the authentic constitution. Since morality is the most important thing in the Law and morality is presented in the Law in the form of principles, there are no antinomies between the principles and there are no unfair legal principles.
