Dogmática penal, Teoría del delito y Teoría del caso: una visión integradora

Abstract

La reforma al texto constitucional de 2008 estableció la implementación del sistema penal acusatorio y oral, modifican profundamente las reglas procesales imperantes. Es una reforma de la mayor trascendencia, que ha originado una serie de debates respecto de la necesidad de la teoría del delito como herramienta conceptual indispensable para la tarea judicial. En este texto se destaca la relación integral entre la dogmática penal, la teoría del delito y la teoría del caso, negada por algún sector mínimo de la doctrina. ---------------------------------------------------------------------------------------------------------

The constitucional reform of 2008 in México, established the accusatory and oral penal system, modifying the prevailing procedural rule deeply. It is a reform of te greater importance, than it has originated a series of debates with respect to the neccessity of te theory of the crimen like conceptual tool for te judicial task. In this paper the relation between for the dogmatic one stands, theory of the crime and theory of the case, denied by some minoritary sector oh te doctrine.
