La cuestionable deriva legislativa de la mediación penal en España, ¿de solución alternativa a las penas a una pena más sin alternativa?

Abstract

En este trabajo se analizan los diferentes problemas que la introducción de una institución de origen eminentemen-te privado, como es la de la mediación, ha planteado en un sistema como el de justicia penal, dotado de una naturaleza y unas fun-ciones eminentemente públicas. Se trata de poner de manifiesto cómo estas diversas na-turalezas no solo están provocando el plan-teamiento de problemas a la hora de que la mediación pueda integrarse adecuadamente en el funcionamiento del sistema penal, sino también cómo, por otra parte, la naturaleza eminentemente pública y represiva del sis-tema penal está determinando que la me-diación esté dejando, en ocasiones, de actuar como un mecanismo alternativo a las penas, para pasar a hacerlo como suerte de nueva modalidad de pena predicable con respecto a los delitos que generan un mayor rechazo social, algo que sería conveniente evitarThis work analyzes the different problems that the introduction of an institu-tion of eminently private origin, such as me-diation, has posed in a system, such as that of Criminal Justice, endowed with an emi-nently public nature and functions. The aim is to highlight how these diverse natures are not only causing problems when mediation can be adequately integrated into the func-tioning of the penal system, but also, on the other hand, the eminently public and repres-sive nature of the penal system is determin-ing that mediation is sometimes ceasing to act as an alternative mechanism to punish-ments, and starting to do so as a kind of new type of punishment applicable with respect to crimes that generate greater social rejec-tion, something that it would be advisable to avoid
