El reclutamiento de menores en el marco del conflicto armado colombiano. Aproximación a la problemática.

Abstract

El reclutamiento de menores en Colombia constituye un crimen de guerra contenido en la legislación nacional y en el Estatuto de la Corte Penal Internacional, de innegable gravedad por la naturaleza de los derechos que resultan afectados con su comisión. A los menores se les anula su dignidad y garantías fundamentales, al obligarlos a participar en conflictos armados, en los que son los blancos más fáciles de los enfrentamientos. La revictimización de los menores reclutados y la cifra negra de criminalidad son características frecuentes en este tipo de crímenes, por ello es importante fortalecer no sólo la investigación y sanción de los responsables, sino además la prevención y medidas de resocialización de los menores que son víctimas de este crimen.

The recruitment of children in Colombia is a war crime contained in national legislation and the Statute of the ICC, the undeniable gravity of the nature of the rights that are affected with the commission. Minors are void and guarantees their dignity, forcing them to participate in armed conflicts, which are the easiest targets of the fighting. The revictimization of children recruited and unrecorded crime are characteristics common to such crimes, it is therefore important to strengthen not only the investigation and punishment of those responsible, but also the measures of prevention and resocialization of minors victims of this crime.
