El ciudadano extracomunitario: de “objeto material” a “tipo de autor” en el control penal de la inmigración

Abstract

En el Derecho penal italiano existe un estatus específico para el inmigrante extracomunitario. En este artículo afrontamos, mediante el análisis dogmático y político-criminal de la legislación penal y de las últimas propuestas de reforma, el problema de hasta qué punto tal estatus vulnera las garantías del ciudadano extracomunitario y genera un Derecho penal de autor.

A specific status for the non communitarian immigrants can be found for Italian criminal law. In this paper, by means of a “dogmatic” and criminal policy analysis of criminal law rules and the latest reform proposals, we will deal with the problem of whether that status violates the rights of non communitarian citizens and constitute an example of criminal law based on the personal characteristics rather than on facts.
