Abstract
La constante necesidad de aumentar el nivel de seguridad del que puede gozar la sociedad ha llevado al Derecho penal a replantearse, una y otra vez, la respuesta jurídica más adecuada frente al delincuente habitual. En 2010 el legislador decide la incorporación al Código Penal de la libertad vigilada, configurada como una medida de seguridad aplicable a sujetos inimputables, semiimputables y a sujetos en los que no se aprecia disminución alguna en su capacidad de culpabilidad. Esta circunstancia obliga a plantearse el fundamento y la justificación que pueden encontrar estas medidas en relación a su aplicación a sujetos plenamente responsables, y, de ser necesario, a sugerir posibles alternativas a la presente regulación.

The need to increase the level of security of the society has led to Criminal Law to consider the best legal response against the habitual offender. In 2010 the legislator decides to incorporate the supervised liberty in the Penal Code, configured as a security measure, applicable to individuals, responsible and not responsible criminally. This fact leads us to consider the rationale and justification for such action in relation to its application to persons fully responsible, and, if necessary, to suggest possible alternatives to this regulation.
