Diversidad cultural y sistema penal

Abstract

La diversidad cultural originada en procesos migratorios tiene gran importancia en la conformación de los sistemas penales europeos. Las penas se agravan cuando el delito se comete por motivos étnicos, raciales o religiosos. Y algunas costumbres foráneas, como la poligamia, no son aceptadas, manteniendo su carácter delictivo. Otro supuesto de multiculturalidad hace referencia al Derecho penal aplicable a los pueblos indígenas en América Latina. Debe respetarse el Derecho penal consuetudinario indígena pero exigiendo la plena observancia de los Derechos fundamentales

The cultural diversity originated in migratory process has great significance in the conformation of the european penal systems. The punishment worsen when the crime is commited by ethnic, racial or religious reasons. And some foreign customs, like the polygamy, are not acepted, maintaining their criminal character. Another assumption of multiculturalism makes reference to the Criminal Law applicable to the indigenous peoples in Latin America.
