Abstract
Con el trasfondo filosófico del transhumanismo, conveniente en cuanto permite contextualizar ciertas propuestas político-criminales, se esboza la posible responsabilidad penal de las “personas artificiales”, haciendo un paralelismo con algunas formulaciones en torno a la responsabilidad penal de las personas jurídicas. Se concluye que, en lógica teórica, determinadas propuestas sobre la responsabilidad penal corporativa permitirían, al menos en apariencia, sustentar la responsabilidad criminal de un sistema o ente artificial.

With the philosophical background of transhumanism, which is convenient in that it allows us to contextualise certain political-criminal proposals, the possible criminal responsibility of “artificial persons” is outlined, drawing a parallel with some formulations regarding the criminal responsibility of legal persons. It is concluded that, in theoretical logic, certain proposals on corporate criminal responsibility would allow, at least in appearance, for the criminal responsibility of a robot.
