Fórmulas de conservación del patrimonio natural en terrenos militares

Abstract

Partiendo de la configuración legal del medio ambiente y de la defensa del Estado, tanto en Argentina como en España, se abordan las soluciones administrativas adoptadas en ambos países para resolver el conflicto entre estos dos bienes jurídicos acreedores de protección cuando concurren sobre un mismo territorio. Se realiza un análisis comparado de las soluciones española y argentina y su relación con las figuras de protección existentes en cada país. Finalmente, se formulan conclusiones sobre las ventajas e inconvenientes de ambos modelos encaminados a ofrecer alternativas para la conservación del capital natural y la ordenación de los diferentes usos concurrentes. ---------------------------------------------------------------------------------------------------------

Starting from the legal configuration of the environment and the defense of the State, both in Argentina and in Spain, the administrative solutions adopted in both countries to resolve the conflict between these two legal assets deserving protection when they coincide in the same territory are addressed. A comparative analysis is made of the Spanish and Argentine solutions and their relationship with the existing protection mechanisms in each country. Finally, conclusions are drawn on the advantages and disadvantages of both models, with a view to offering alternatives for the conservation of natural capital and the management of the different competing uses.
