Abstract
El Código Nacional de Procedimientos Penales como legislación única y su reciente incorpo-
ración al sistema constitucional, así como su impacto en la teoría de los órdenes jurídicos, son el punto de
partida que el autor maneja en este artículo. Para demostrar su hipótesis, el autor se introduce a la teoría
de la constitución a efecto de esclarecer la naturaleza jurídico-constitucional de esa nueva categoría a
la luz del federalismo mexicano, a fin de argumentar, desde el ámbito de lo constitucional, la necesidad
de transitar hacia el federalismo dúctil que posibilite una pacífica implementación del sistema de justicia
penal acusatorio.
The National Code of Criminal Proceedings as unique legislation, its recent incorporation to constitutional system and its impact in legal systems theory are the starting points of this paper. In order to prove his hypothesis the author made a revision of constitutional theory for the purpose of clarify the juridical and constitutional nature of this new category seen from the Mexican federalism. In this way is possible to argue, from the constitutional sphere, the need to move toward a ductile federalism to make possible a pacific implementation of the accusatory criminal system.
