Abstract

La tendencia del legislador penal español de los últimos tiempos ha sido incrementar e intensificar sin límite la legislación penal. Pero más alarmante es aún ante la criminalización de los discursos extremos y el llamado discurso del odio terrorista. Ante el miedo que generan los ataques terroristas, el legislador penal, a veces movido por mandatos internacionales, y otras por reclamos sociales, ha visto justificado adelantar las barreras de intervención penal a momentos muy previos a la efectiva lesión de bienes jurídicos para tratar de inocuizar cualquier posible conducta terrorista y para ello no ha tenido problema en poner en juego la seguridad y garantías de nuestro propio Estado de derecho y poner en jaque derechos como la libertad de expresión
