Introducción al sistema Anti-corrupción de la República Popular China

Abstract

El objetivo de este artículo es analizar los principales instrumentos que el Derecho penal chino ha utilizado en su lucha contra la corrupción. En esta línea, se destaca cómo, en los últimos tiempos, el Partido Comunista chino ha tomado conciencia de la importancia de este fenómeno y cómo ha decido afrontarlo respondiendo a las exigencias del Derecho internacional, tratando de construir un Derecho penal anti-corrupción menos severo, pero también más eficaz en la lucha contra la peligroso fenómeno criminal. ---------------------------------------------------------------------------------------------------------

The aim of this paper is to analyze the main instruments used by Chinese Criminal Law in its fight against corruption. Accordingly, it is highlighted how over the last years the Communist Party has become aware of the importance of this phenomenon, and how has decided to deal with it by answering to the international law´s requirements, attempting to create a less strict anti-corruption Criminal law, but also more efficient in the struggle against this dangerous criminal phenomenon.
