Un estudio de la Ley de Promoción de la Autonomía Personal y Atención a las Personas con Dependencia, desde la seguridad social

Abstract

La nueva Ley de Promoción de Autonomía Personal y Atención a las Personas con Dependencia -LPAP-, ha creado una nueva modalidad de protección social de la dependencia, diferente a la que ya existía, aunque de forma dispersa e indirecta, dentro del Sistema de la Seguridad Social. El propósito de este artículo, una vez delimitado el concepto de "situación de dependencia", y determinada la naturaleza de las nuevas prestaciones, es estudiar la compatibilidad y relación de las prestaciones derivadas de la Seguridad Social y las derivadas de la nueva Ley. Finalmente, se estudiará la modificación del art. 145 de la Ley General de la Seguridad Social -TRLGSS-, operada por la disposición adicioonal decimosexta de la LPAP.____________________________________The new Promote Personal Autonomy and Care for Dependent People Act, has created a new modality of social protection for dependency, different from the one existing up to now, although in a disperse and indirect manner,within the Social Security System. The main aim of this research, once the concept of situation of dependency is defined and beeinnq the nature of the new benefits determined, is to study , the compatibility , and the conexion between the benefits of Social Security , and those created by the new Act. Finally, we will study the modification of the art. 147 of Social Security Law.
