Abstract
La presunción de inocencia constituye el punto de partida del nuevo sistema de justicia penal, es por ello que resulta imposible su coexistencia con figuras que la hacen nugatoria, como es el caso del arraigo constitucionalmente previsto, el cual es derivado de su ley reglamentaria. Pareciera que el legislador ha optado por considerar grave casi toda conducta ilícita para poder justificar el arraigo, y el mismo parece ser la regla general y no la excepción; lo cual es completamente contrario al principio de presunción de inocencia y la concepción de un Estado democrático.
The presumption of innocence is the starting point of the new system of criminal justice, so that their coexistence that is impossible with figures that make it inexistent, as it is the case of the rooting constitutionally provided; derived from its regulatory act it seems that the legislator has chosen to consider felony almost all conduct to be able to justify the rooting, and the same seems to be the rule and not the exception; which is completely contrary to the principle of presumption of innocence and the conception of a democratic State.
