El delito de tráfico ilegal de órganos humanos

Abstract

El trabajo se ocupa de delimitar el alcance del art. 156 bis, introducido al CP por la reforma operada por la LO 5/2010, relativo al tráfico ilegal de órganos. Punto de partida de esta tarea es precisar cuál sea el bien jurídico protegido en la norma, una cuestión que se presenta ciertamente compleja a la luz de los elementos típicos del delito. La presente contribución parte de que el interés protegido es el control estatal de los distintos actos relacionados con el trasplante, lo que implica, junto con otros intereses de alcance colectivo, la preservación de políticas públicas de salud. A partir de lo anterior, la presencia de elementos típicos relacionados con la vida o salud de los concretos afectados opera como un criterio de restricción del alcance del precepto. ---------------------------------------------------------------------------------------------------------

The present article deals with the interpretation of the art. 156 bis Penal Code, introduced by LO 5/2010, concerning trafficking in human organs. For this purpose, the paper point out the interest protected by the norm, which appears as a debated question due the characteristics of this crime in Penal Code. The paper considers that the protected interest is the state control of different acts concerning transplantation human organs, which includes among other aspects publics health policies. According with this viewpoint, the meanings of elements of the offense relating to the protection of life and health consists of reducing the scope of the offense.
