El debate normativo sobre el castigo en la justicia penal

Abstract

La discusión normativa sobre el castigo debe tener un lugar privilegiado dentro de la reflexión y el programa de la justicia penal. Sin embargo, ello exige dos cosas. Por un lado, tener presente el calado de los interrogantes implicados en la cuestión de la justificación de esta institución y de las prácticas que caen dentro de ella. Por otro lado, hay que reconocer que este recorrido de propuestas normativas no es un fin en sí mismo y no sucede en abstracto, desapegado de los contextos específicos y de las prácticas concretas de castigo. El objeto de este texto consiste en reivindicar la teoría normativa sobre el castigo como un elemento fundamental para la comprensión y la transformación de los fenómenos sociales relacionados con la justicia penal; una comprensión que no puede ser fácticamente indiferente, pero tampoco normativamente ciega.

The normative discussion of punishment should have a privileged place in the thinking and agenda of Criminal Justice. However, this requires two things. On the one hand, it is necessary to be aware of the depth of the questions involved in the issue of the justification of this institution and of the practices that fall within it. On the other hand, it is also necessary to recognise that this series of normative proposals is not an end in itself and does not take place in the abstract, detached from the specific contexts and concrete practices of punishment. The purpose of this text is to claim that the normative theory of punishment should be considered a fundamental element in understanding and transforming of social phenomena related to criminal justice. An understanding, however, that is neither factually indifferent, nor normatively vacuous, being reduced to its facticity.
