Análisis del dolo y sus elementos en el delito de homicidio de persona internacionalmente protegida: cuestiones problemáticas

Abstract

El delito de homicidio en persona internacionalmente protegida se estructura sobre las condi-ciones especiales del sujeto pasivo del crimen. El estatus jurídico de la persona internacionalmente prote-gida garantiza no solo la protección de bienes jurídicos personalísimos, también la tutela de intereses esta-tales en el extranjero a través del principio de extraterritorialidad, no impunidad y judicialización efectiva. El análisis del dolo en este delito se basa en el elemento cognitivo del animus necandi, con independencia de la intencionalidad que persiga el autor. Los criterios adoptados por la jurisprudencia del Tribunal de Apelaciones del Cuarto Distrito aportan las directrices de interpretación del delitoThe crime of homicide in internationally protected persons is structured on the special con-ditions of the victim. The legal status of the internationally protected person guarantees not only the pro-tection of personal legal interests, but also the protection of state interests abroad through the principle of extraterritoriality, in order to prevent impunity through effective prosecution. The analysis of intent in this crime is based on the cognitive element of the animus necandi (“will to murder”), regardless of the intentionality pursued by the author.
