Abstract
La prisión preventiva es una medida cautelar que debido a su intensa intervención en los derechos a la libertad personal
y la presunción de inocencia es considerada
generalmente como una medida extraordinaria. Sin embargo, en el sistema jurídico
mexicano existe la figura de la prisión preventiva oficiosa, la cual se ordena de manera oficiosa en cualquiera de los delitos dispuestos
en el art. 19, párr. 2 de la Constitución mexicana. Esta aplicación inmediata condujo a la
Corte Interamericana de Derechos Humanos
a condenar al Estado mexicano por incumplir
con sus obligaciones internacionales emanadas de la Convención Americana de Derechos
Humanos. El objetivo de este trabajo consiste
en armonizar la prisión preventiva oficiosa con los criterios de la Corte Interamericana
a partir de la configuración actual del sistema jurídico mexicano. Lo anterior será posible al establecer los fundamentos del test de
proporcionalidad para esta medida cautelar
y explicar su estructura. Todo esto, a través
de las herramientas desarrolladas por la dogmática de los derechos fundamentales
Pre-trial detention is a precautionary measure that, due to its intense interference in the rights to personal freedom and the presumption of innocence, is generally considered an extraordinary measure. However, in the Mexican legal system, there is the figure of mandatory pre-trial detention, which is automatically ordered for any of the offenses listed in art. 19, para. 2 of the Mexican Constitution. This immediate application led the Inter-American Court of Human Rights to condemn the Mexican State for failing to comply with its international obligations under the American Convention on Human Rights. The objective of this work is to harmonize mandatory pre-trial detention with the criteria of the Inter-American Court based on the current configuration of the Mexican legal system. This will be possible by establishing the foundations of the proportionality analysis for this precautionary measure and explaining its structure. All this, through the tools developed by the dogmatics of fundamental rights
