Abstract
La
fi
losofía personalista, en lo que hace a la democracia y al
derecho, es bastante interesante por dos razones: (i) porque re-descubre
las relaciones entre el ser humano y democracia como una relación
fi
nes-
medios. El problema cognoscitivo de la relación determinismo-libertad,
en la práctica, se transforma en un problema de “medios-
fi
nes”; y (ii)
porque elucida la conexión entre historia, derecho y democracia, como
una tensión histórica de “mediaciones” o estructuras instituidas e insti-
tuyentes. Digamos que el personalismo retoma, por un lado, la idea de
democracia como proyecto histórico, para que podamos imaginarla de
nuevo como un instrumento “material y contingente”, que no niegue el
desarrollo histórico de la realidad; y, por otra, concibe una nueva forma
de pensar el derecho, re-situando al ser humano como el principio ma-
terial de todo el fenómeno jurídico. Por eso el personalismo se con
fi
gura
como una propuesta “iusmaterialista”, porque sitúa la acción humana
como la referencia cognoscitiva básica.
Personalist philosophy, referred to Democracy and Law, becomes really interesting because of two reasons. First, it rediscovers the relationships between man and democracy, as a purpose-effort relation. And then, it considers/explains the connection among history, law and democracy as a historical tension of “mediations/intercessions”. Thus, personalism takes up again the idea of democracy in two different ways. On the one hand, as a historical project, so that we can image it once again, as an instru- ment that does not deny the historical development of reality. And on the other hand, it has got a new idea of thinking Law. It rede fi nes human being as the material principle of every legal phenomenon. That is the reason why personalism is considered an “iusmaterialistic” proposal: it places human action as a basic cognitive reference of Law.
