La herencia de Franz von Liszt

Abstract

Franz von Liszt fue uno de los más importantes especialistas en Derecho penal y Política criminal a finales del siglo XIX en Alemania. En al ámbito del Derecho penal fue un decidido partidario del Estado de Derecho, considerando que el Derecho penal debería ser una infranqueable barrera para la Política criminal. Pero luego en relación con la delincuencia habitual y la reincidencia proponía fuertes medidas de inocuización (Unschädlichmachung) e incluso la pena de prisión de duración indeterminada, que luego influyó notoriamente en la Política criminal del Nacionalsocialismo en esta materia. Este artículo analiza esta doble y contradictoria personalidad académica y científica de Franz von Liszt. ---------------------------------------------------------------------------------------------------------

Franz von Liszt was one the most important specialist on Criminal law and Criminal policy at the end of XIX. Century in Germany. In the field of Criminal Law he strongly supported the rule of law and considered the Criminal Law as a barrier of the Criminal policy. But in the field of recidivist delinquency he was specially worried about that and proposed hard measures of elimination (Unschädlichmachung) and long life prison against recidivists, that influenced strongly the Criminal policy during the National socialism in this area. The article analyzes this double contradictory side of the academic and scientific personality of Franz von Liszt.
