La tipificación del fraude en las prestaciones del sistema de Seguridad Social: el nuevo artículo 307 ter del Código Penal

Abstract

La Ley Orgánica 7/2012, de 27 de diciembre, en materia de transparencia y lucha contra el fraude fiscal y en la Seguridad Social, incorporó a nuestro Ordenamiento jurídico un nuevo delito: el fraude en las prestaciones del sistema de la Seguridad Social (art. 307 ter CP.). En este trabajo se analiza el contenido de este tipo penal. Con objeto de realizar una primera aproximación al estudio de este nuevo delito, resulta posible extrapolar algunas de las consideraciones que desde hace tiempo se han venido efectuando por parte de la doctrina en relación con el delito de estafa. Como resultado de este proceder interpretativo se consigue arrojar algo de luz al contenido de esta nueva figura, a día de hoy carente de pronunciamientos en la doctrina. ---------------------------------------------------------------------------------------------------------

The Spanish Organic Law 7/2012 of 27 December on transparency and the fight against tax fraud and Social Security, joined our legal system a new offense: benefit fraud of the Social Security system (307 ter article of the Spanish Penal Code). In this paper we analyze the content of this crime. For a first approach to the study of this new legal concept, it is possible to compare it with the scam crime. As a result of this interpretation we get to explain the content of this new crime, that currently the scientific literature has not studied.
