El testigo protegido en el contexto del crimen organizado. Fases de protección e implicaciones procesales y afectación a la dignidad humana

Abstract

El testigo protegido constituye una figura procesal de carácter probatorio que la policía y el Ministerio Público pueden tener a su disposición cuando las circunstan-cias de un caso, dentro del contexto de cri-minalidad organizada así sea requerido, en especial cuando las posibilidades de conocer la estructura interna del grupo criminal, así como toda su actividad criminal no tenga otra opción y, se facilite la identificación de sus autores y la recopilación de la prueba útil y pertinente sobre la actividad y estructura funciona de la organización.Desde esta perspectiva, el Estado debe asegurarle al testigo protegido y a su vínculo familiar más cercano, su integridad física y la vida, que podrían estar expuestos al riesgo de muerte por la colaboración que brinda el testigo. Esta investigación contempla las di-versas fases de protección del testigo y que, ante un pronunciamiento de carácter constitucional de la Sala Constitucional de Costa Rica, debe mantenerse dicha protección úni-camente hasta la etapa intermedia del proce-so y no, en la de juicio; lo cual atenta contra la seguridad física del testigo, causando coinci-dentemente una total desmotivación para quien desee colaborar con la administración de justicia.La figura del testigo protegido es ana-lizada desde un punto de vista normativo procesal, jurisprudencial, doctrinario y con-vencional, en el cual se relaciona con el prin-cipio de dignidad humana y el principio de defensa

The protected witness is a proce-dural figure of an evidentiary nature that the police and the Public Prosecutor’s Office may have at their disposal when the circumstan-ces of a case, within the context of organized crime, so require, especially when the possi-bilities of knowing the internal structure of the criminal group, as well as all its criminal activity, have no other option and the identi-fication of the perpetrators and the collection of evidence is facilitated useful and relevant to the activity and structure of the organiza-tion.From this perspective, the State must ensure the physical integrity and life of the protected witness and his or her closest fa-mily members, who could be exposed to the risk of death due to the witness’s collabora-tion. This investigation contemplates the va-rious phases of witness protection and that, in view of a constitutional pronouncement of the Constitutional Chamber of Costa Rica, such protection should be maintained only until the intermediate stage of the process and not at the trial stage, which threatens the physical safety of the witness, coinciden-tally causing a total lack of motivation for those who wish to collaborate with the ad-ministration of justice.The figure of the protected witness is analyzed from a procedural, jurisprudential, doctrinal and conventional normative point of view, in which it is related to the principle of human dignity and the principle of defense
