Abstract
La Ley de Memoria Histórica constituye el último paso del largo proceso de aplicación de respuestas
jurídicas constitucionales a los excesos de la guerra civil y de la dictadura franquista que envolvió a España entre 1936
y 1939. Su examen hace visibles luces y sombras en proporciones diferentes. No se llega, por ejemplo, a proclamar la
nulidad de las sanciones impuestas por el aparato franquista, sino sólo su injusticia. Y la primacía de lo reparatorio
deja de lado lo colectivo o institucional.
Este olvido de lo institucional es particularmente grave en el caso de la Universidad. Privada de sus mejores hombres
por la aniquilación o el exilio, quedó en manos de intelectuales militantes en el totalitarismo, que conformaron una
Universidad acientífica y complaciente con el franquismo. Las consecuencias de esa política practicada durante
décadas fueron nefastas y algunas perviven todavía.
The Historical Memory Law is the last step in the long implementing process of constitutional legal replies to the excesses of the civil war and Franco’s dictatorship that involved Spain between 1936 and 1939. Its exam makes visible lights and shadows in different proportions. It doesn’t reach, for example, to declare the nullity of the sanctions imposed by the Franco regime, but just its injustice. And the primacy of reparative objectives puts aside the collective or institutional perspective. This oblivion of the institutional perspective is particularly serious in the case of University. Deprived of its best people because of annihilation or exile, it remained in the hands of totalitarian intelectuals, which shaped an unscientific and accomodating with the Franco regime University. The consecuences of such a policy, practiced for decades, were disastrous and some are still prevalent.
