Armonización europea y previsión de responsabilidad de las personas jurídicas en el Código penal español

Abstract

Las últimas reformas del Código Penal se justifican con frecuencia en sus Exposiciones de Motivos por la necesidad de adecuar la normativa española a la regulación europea. Así ocurre también en la Ley Orgánica 5/2010. En lo que en ella atañe a la previsión de responsabilidad penal de las personas jurídicas, el legislador opta por un numerus clausus que en este análisis se pretende estudiar en qué medida es fiel a dicha regulación. ---------------------------------------------------------------------------------------------------------

The latest reforms of the spanish penal code are often justified in its explanatory preambles by the need to adapt spanish legislation to european regulation. This is true also in the Ley Orgánica 5/2010. In it concerning to the possibility of criminal responsibility of legal persons, the legislator opts for a numerus clausus which in this analysis is intended to study to what extent it is faithful to such regulation.
