Abstract
Se analiza la crisis contemporánea de la ley y del Principio de legalidad, destacando que no todos
los contenidos de la legalidad penal padecen dichos efectos negativos. El Principio de irretroactividad de
la ley penal se encuentra a salvo de cualquier crisis por ser irrenunciable. También están a salvo aspectos
sustanciales de los principios de reserva de ley y de determinación. En síntesis, el Principio de legalidad
no muere pero sí se transforma, exigiendo al jurista un nuevo empeño.
This paper explores the contemporary crisis of law and the legality principle, emphasizing that not all contents in criminal legality have such negative impacts. The principle of non-retroactivity of penal law is free from any crisis because it is unavoidable. Other crucial aspects of the principles of reserve of the law and determination are also exempt of crises. Briefly, the legality principle does not expire but it is transformed requiring from the jurist further effort.
