Mujeres privadas de la libertad y maternidad en México

Abstract

A nivel global, en las últimas décadas, el número de mujeres en prisión ha aumentado a una tasa más alta que la de los hombres. El crecimiento cuantitativo contrasta con algunos aspectos cualitativos, relacionados con los perfiles de las mujeres privadas de la libertad, el tipo de delitos por los cuales son acusadas y, finalmente, sus historias de vida y las responsabilidades de cuidado de personas dependientes que están a su cargo. En el presente texto se analiza si y cómo los derechos de las mujeres que son madres y los de sus hijas e hijos se implementan en el sistema penitenciario mexicano. Se elaboran propuestas legislativas y jurídicas para la incorporación de la perspectiva de género y el interés superior de la niñez en la atención de las mujeres privadas de la libertad y sus hijas e hijos.

Globally, in recent decades, the number of women in prison has increased at a higher rate than that of men. This quantitative growth contrasts with some qualitative aspects related to the profiles of incarcerated women, the types of crimes for which they are accused, and, finally, their life stories and the caregiving responsibilities for dependent individuals in their charge. This text analyzes whether and how the rights of women who are mothers, as well as those of their daughters and sons, are implemented within the Mexican prison system. Legislative and legal proposals are developed for the incorporation of a gender perspective and the best interests of the child in the care of incarcerated women and their children.
