Abstract
En el presente artículo el autor hace una comparación entre diversos tipos penales y figuras selectas del Derecho Penal sustantivo que se encuentra en Common Law y en el Derecho Penal Internacional para tratar de establecer hasta qué grado esta tradición jurídica ha influido en esta rama del Derecho Internacional. Después de analizar textos legislativos y resoluciones judiciales el autor concluye que la influencia no ha sido tan importante cómo comúnmente se percibe; sin embargo, del Common Law se pueden extraer diversas herramientas de sistematización y análisis que ayudarían a comprender mejor el Derecho Penal Internacional.
This paper compares different criminal types and selected figures from fundamental criminal law found in Common Law and international criminal law in order to find out how this law tradition has influenced this branch of international law. After examining juristic writings and judicial decisions the author comes to the conclusion that this influence has not been as considerable as commonly thought. Nonetheless Common Law can provide several tools for systematization and analysis that could contribute to a better understanding of international criminal law.
